Captain Vincent Averna US Navy Judge Advocate General (Guantanumo Navy Base Review-A Few Good Men)
The following assessment is based on the irrefutable information and material provided to Captain Averna.
The denial of Constitutional PROCEDURAL Due Process is at the very heart of the injustice done to Nary as follows
1. The illegal removal of the sailor from; the ship(USS Carl Vinson) where he was in custody was effectuated by the State of California (San Francisco District Attorney Terrance Hallinan)through their failure to follow their own procedures for delivery of servicemen from Federal Jurisdiction.
(The city officials--Terrance Hallinan falsified the delivery(military turnover )document by failing to obtain the Governor's(Pete Wilson's)signature or that of his Attorney General Dan Lundgren
2. The statutes--Code of Federal Regulation sections 700-722 passed to protect servicemen from the unjust actions of hostile local authorities detail(specific) procedures that were also ignored by the Navy, in that they allowed city officials to obtain illegal in-personam jurisdiction over Nary; when his ship's commanding officer -Lieutenant Susan Kazmer of the Navy Investigative or Navy Criminal Ivestigative Service/NIS/NCIS agent on board the USS Carl Vinson at that time in place of Captain Baucom) after an illegal midnight interrogation without either a civil or Navy JAG lawyer present--. Illegally turned Nary over to the San Francisco police without getting the permission of John Dalton, the Secretary of the US Navy ( 1996).
Dalton's successor, Mr. Danzig also never gave his permission for Hallinan and Ryan to prosecute and try sailor Nary. Nor did Governors Wilson, and his succesor, Grey Davis ever seek the mandatory federal military permission from the Navy Secretary to detain, prosecute and imprison sailor Steve Nary.
Bill Lockyer, the California State Attorney General also never filed any responses/ legal briefs in federal court to prove that Hallinan and Ryan had jurisidiction to prosecute, try and imprison sailor Nary! Lockyer in fact filed a waiver in the US Supreme court to file any prosecution of sailor Nary. This waiver was censored in the homophilic press by its media morons.
San Francisco's homosexual population's; hostility to the Navy is well known and the prosecutor's (John M. Farrell),comments about the "homophobic US Navy provides that proof.
3. The judge (Kevin Vincent Ryan-San Francisco County Court) failed to follow courtroom and trial procedures designed to insure a fair trial for the accused by allowing pro-homosexual demonstrations to take place inside his courtroom while the trial was in progress(October 1999.
San Francisco Judge Kevin Ryan then further influenced the jury by inviting the demonstrators (and the media--Johnny Brannon, Elizabeth Fernandez, Kathy AKA Zak Syzmanski,Dennis Opatrny and others, CUAV/ NAMBLA)to the same lunch; with the jury;
4. Nary's innocence of 2nd degree murder could not be shown because the defense attorney (Bruce Hotchkiss***) didn't stand up to the prosecutor(Terrance Hallinan) and the judge (Kevin Ryan) (both of whom had contributed to each other's election prior to the kangaroo court trial).
They, Hallinan, Farrell and Ryan ignored and defied the procedures for showing the alleged victim Juan Pifarre was in fact a homosexual predator and illegal alien-(-with several prior sexual assaults according to the San Jose & San Francisco Police Records) Hallinan, Farrell and Ryan also circumvented the finding that Pifarre had AIDS, by the cremation of the body, on April 1, 1996. Hallinan prevented the autopsy from reflecting the body's condition as to drugs(cocaine, meth etc.)or Pifarre Hepatitis status.
(At the end of March 1996, Pifarre's two brothers traveled up from Argentina to San Francisco to look for assets; after finding a small sum of money, they refused to bring back Pifarre's diseased corpse to Argentina for burial. It was cremeated, and the ashes were dumped into San Francisco Bay
Pifarre's brothers were board members of the Bank of the Province of Buenos Aires, the oldest bank in Argentina. This bank is creditably suspected of having assets stolen from European Catholics, Jews, Gypsies and others during World War Two.
Because Argentina has always provided refugee from Nazi war criminals, Adolph Eichman and other war criminals may have banked there).
Nary's broken hand received while defending himself from the attack was also not developed (or admitted). It was also censored in the libelous reporting done by Johnny Brannon(SF Independent), Elizabeth Fernande(SF Examiner/ SF Chronicle), Kathy Syzmanski(Bay Reporter prostitution paper), Dennis Opatrny( The Recorder Legal News Reporter) and other media flotsam.
5. The San Francisco court judge Kevin Ryan failed to follow California judicial procedures when he proceeded with the state trial after he was informed that removal to federal court, Judge Charles Legge had been legally done in June 1999,over three months prior to Kevin Ryan's illegal takeover and usurpation in September 1999 of federal military jurisdiction.
Nary was never given a federal public defender, nor a federal district court hearing--all illegal and violations of his federal military due process rights.
On October 28, 1999, coincidentally Ryan's birthday--he concealed the fact that he was born in Alberta Canada, or how he entered the US--Ryan's kangaroo court jury of odvious lesbians and homosexuals "found sailor Nary guilty of second degree murder. They also lied about Nary using a "club" to beat Pifarre. Pifarre did break a shower rod, and used that rod to break Nary's hand so he wouldn't resist Pifarre's AIDS contaminated rape.
Ryan tacked on an additional year for the use of a nonexistant club. Sailor Nary was illegally sentenced by Ryan to 16 years in the California Prison system.
(When Kevin Ryan took the case in September 1999and rigged it, Nary 's filings were in the 9th federal circuit Appellate Court, which did not and could not remand-or order back the sailor's case to a local San Francisco court). Although Nary filed his case with the correct title of his military status,"US Navy Apprentice Airman"the 9th federal court clerk and staff attorney W(alter) Manning Evans illegally deleted Nary's Navy status from the filing of the case in federal court. It is creditably suspected that they also concealed this status information from the federal appellate court judges. There was no hearing in the federal appeallate court, Nary then appealed to the US Supreme Court.
One of the odvious gay docket clerks sneered, to Nary's legal representative, who filed his legal briefs:"This case is going nowhere." Evans contempously remarked:"I'm not going to do your work."
Hallinan ignored the federal court filings, never responded to any of them, but proceded with his expensive kangaroo court prosecution of sailor Steven Nary.
In November 1999,at the conclusion of Ryan'-Hallinan's Kangaroo court trial, Judge Kevin Ryan approved ,***Hotchkiss $30,000 payment as the San Francisco court appointed defense lawyer.
Bruce Hotckiss later received over $100,000 of public court payments for his defense of the Knollers in the notorious Lesbian dog bite death case, which was presided over in Los Angeles County--where that case was removed--by Judge James Warren. Warren is the grandson of the late US Supreme Court Chief Justice Earl Warren.
"James Warren was recently outed as gay." After the public exposure of his "willful misconduct" and sworn written complaints by witnesses were made to both the FBI and the California Commission on Judicial Performance-which ignored the witnesses_--Ryan first applied for a vacant federal district court judgeship, ironically Charles Legge's.
After evidence of Ryan's judicial misconduct and public corruption leaked out, Ryan was dropped as a candidate for Judge Charles Legge's position.
.In May of 2000, Ryan's political godfathers and political godmothers- corrupt Senator Diane Feinstein then
steered Ryan's name through the US Senate's Judiciary committee for the vacant US Attorney's post for Northern California( San Francisco) Feinstein also placed Angela Bradstreet the corrupt British Lesbian on the California 9th federal circuit candidate selection committee. Bradstreet and the other political corruptors then rubber stamped Ryan for the US Attorney's position. Bradstreet is a beneficiary of the near million dollar bribe by James C. Hormel; she was the lesbian lover of San Francisco Judge Ann Bouilane, who denied sailor Nary bail and removal of the case to the proper jurisdiction of the federal court. ( in1997)
Feinstein also concealed this bribe from the Senate, when Hormel applied to be ambassador to Luxembourg. Hormel also concealed his secret $250,000 payment to the bogus military legal defense fund mis named "The Serviceman's Legal Defense Fund." This group does not defend hetrosexual military personnel, who are accused of violating the Universal Code of Military Justice or any other federal laws and statutes.
